SC Scraps Its Own Stay Order In CG Telecom Case

Supreme Court vacates its stay order to let CG Telecom operate mobile service. Before SC provided a stay order instructing NTA to give permission to CG telecom for Mobile service operation, on December 27, 2018.

Joint of Chief Justice Cholendra Samsher Rana and Judge  Ishwor Khatiwoda has come to a decision to dismiss Earlier’s Stay order done by Judge Dipak Raj Joshi.

SC’s Judge Dipak Raj Joshi made the decision in favor of CG Telecom. With which, they declared to operate 4G mobile service in 2019. The government had already decided to provide basic telephony license to CG Telecom back in Jestha 14, 2074. But NTA invited telcos for the auction of residual spectrum in 900/1800/2100 MHz band on Poush 4, 2075. Then CG telecom went to Supreme Court against the frequency auction, which hinders them from getting frequency spectrum.

Disagreeing with the SC’s decision, NTA filed a petition to reverse the interim order done in favor of CG Communication  (CG Telecom). NTA claimed the interim order was not based on legal issues and facts. NTA also argued the order came without any opportunity to clarify for the issue.

The government decided to give Unified license to CG Telecom, on Jestha 2074. But NTA did not issue the license to CG Telecom as some dues and conditions were not cleared. CG had been asking to get the license ever since which has no progress yet.

In the year 2069, NTA had called for the Unified license for which 4 out of total 6 operators had applied. CG Telecom had acquired American Investment STM Sanchar, a rural telecom service provider based on VSAT technology. Then they also applied for the license which required to have operated a cellular service. But that time, STM only had PCO service based on VSAT technology. That time, UTL and Smart Telecom get the unified license.

Unified License

The Unified license enables an operator to run all of the telecommunication services, throughout the country. It is also termed as basic telephony license earlier intended to provide the license to the telcos operating in limited areas. Till now, 4 telecom operators have got the license. Ntc, Ncell, Smart Telecom, and UTL.

Now with this latest decision, it will be very difficult for CG Telecom to operate mobile service soon. So, the residual frequency auction called by NTA will also move ahead.
